TERMS & CONDITIONS OF CARRIAGE
These Terms and Conditions govern all transportation services provided by Mayor Freightways Ltd. (“Carrier”) to any customer, broker, or their representatives (collectively, “Customer”).
By confirming a load with Carrier through any means (email, phone, text, load boards, or otherwise), the Customer agrees to be bound by these Terms and Conditions in full.
All rate quotes are exclusive of taxes, tolls, border fees, fuel surcharge, detention, layover, TONU (Truck Ordered Not Used), or any other accessorial charges unless explicitly stated in writing.
Payment terms are Net 30 days from the invoice date, unless otherwise agreed in writing. Overdue payments may incur interest at 2% per month (24% annually). The Customer is liable for all reasonable costs, including legal fees, associated with the collection of unpaid invoices.
Detention charges apply after first 2 hours for all FTLs and after 1 hour for all LTLs at $75/hr. Detention charges for Specialized/Oversized loads are $120/hr. Please refer to our website for complete terms and conditions regarding TNU and Detention charges. Detention is billed in CAD/USD matching the original load currency.
Any layover resulting from delays in loading or unloading by the shipper or receiver, delays caused by the broker, customs clearance, or any other circumstances beyond the Carrier’s control will be charged at a flat rate of $300 per calendar day (in CAD or USD, consistent with the original load currency).
A Truck Ordered Not Used (TONU) charge of $200 (in CAD or USD, matching the original load currency) will apply if the truck is dispatched and travels less than 100 miles before the shipment is cancelled or found not to be ready. A Truck Ordered Not Used (TONU) charge of $300 (in CAD or USD, matching the original load currency) will apply if the truck has been dispatched and travels 100 miles or more before cancellation or determination of non-readiness.
If a shipment is re-dispatched after a failed initial attempt, each dispatch is treated independently, and a separate TONU will apply for each failed dispatch.
Carrier assumes liability for loss or damage to cargo in its possession, subject to applicable limitations under governing law or as declared on the bill of lading. Carrier is not liable for delays, damages, or losses arising from force majeure events, including but not limited to weather, strikes, accidents, road closures, acts of God, customs holds, or other events beyond its control.
All cargo claims must be submitted in writing within 30 days of the date of delivery or expected delivery. Claims must be accompanied by proof of value, invoice, and loss documentation. No claims shall be catered to after 30 calendar days from the date of delivery. Customer/Broker is responsible for ensuring that the carrier is notified of any claims within 30 calendar days from the date of delivery.
The Customer is responsible for providing accurate shipment details, including commodity description, weight, dimensions, special handling instructions, and all documentation required for cross-border transportation, including but not limited to commercial invoices, BOLs, and customs clearance paperwork.
Carrier will not be liable for delays, penalties, or missed delivery appointments resulting from inaccurate or incomplete shipment information or documentation provided by the Customer or its representatives.
If the Customer is a broker, freight forwarder, or other intermediary, it warrants that it has the legal authority to bind the shipper and/or consignee to these Terms and Conditions.
Carrier reserves the right to communicate directly with shippers, consignees, or any other party involved in the shipment regarding delivery, status, or claims.
These Terms and Conditions are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. All disputes shall be resolved exclusively in the courts of British Columbia.
Carrier reserves the right to amend or update these Terms and Conditions at any time without prior notice. The current version will be made available at www.mayorfreightways.com/terms.
By confirming any load with Mayor Freightways Ltd., the Customer/Broker acknowledges full acceptance of these Terms and Conditions.
